Alain Sherter, in his blog post, "States Need Bigger Role in Halting Predatory Lending," on b-Net, reports that 'Big banks lobbied hard for federal preemption because state laws are typically more stringent.  By contrast, many legal experts said at the time that the new rules improperly overturned years of legal precedent.. Consumer advocates also predicted that the regulatory shift would lead to lending abuses.

The UNC study may be the first scientific evidence of that.

The Big Picture, says you will not be surprised at the net results of the center's anti-predatory lending study.  In,"STUDY: Federal pre-emption of State Anti-Predatory Lending Laws Led to More Mortgage Defaults," the writer states that among the key factors were "the decision by the Bush White House in 2004 to preempt state lending standards," whereby " ...banks should only be subject to federal laws regulating mortgage credit."
